These Terms of Service (“Terms”) govern your access to and use of the Nementum application and website (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. The Service
Nementum is a digital self-development platform that provides AI-generated routines, insights, and guidance based on user-provided information and contextual data. The Service is intended for personal development and informational purposes only.
2. Eligibility
You must be at least 13 years old to use the Service. By using Nementum, you confirm that you meet this requirement.
3. Account & Use
You are responsible for providing accurate information during onboarding, maintaining the confidentiality of your account, and all activity that occurs under your account. You agree not to misuse the Service or attempt to access it in an unauthorized manner.
4. AI-Generated Content Disclaimer
Nementum uses artificial intelligence to generate personalized content. All AI-generated content is provided for informational and self-development purposes only and does not constitute medical, psychological, legal, or professional advice. You are solely responsible for how you interpret and apply any information provided by the Service.
5. No Medical or Therapeutic Services
Nementum is not a medical, mental health, or therapeutic service. The Service does not diagnose, treat, cure, or prevent any medical or psychological condition. If you are experiencing a medical or mental health emergency, seek professional assistance immediately.
6. Subscriptions & Payments
Some features of the Service require a paid subscription. Subscriptions are billed through Apple In-App Purchases. Prices and billing periods are displayed before purchase. Subscriptions automatically renew unless canceled through your Apple ID settings. Nementum does not control or manage refunds, which are handled by Apple according to their policies.
7. Free Trials
If a free trial is offered, it will automatically convert into a paid subscription unless canceled before the trial period ends.
8. Intellectual Property
All content, features, designs, text, graphics, and software associated with Nementum are owned by Nementum or its licensors. You may not copy, modify, distribute, or exploit any part of the Service without prior written permission.
9. Acceptable Use
You agree not to use the Service for unlawful purposes, attempt to reverse engineer or interfere with the Service, submit harmful, abusive, or misleading content, or use the Service in a way that could damage or impair its operation. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Availability & Modifications
We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for interruptions or changes to the Service.
11. Limitation of Liability
To the maximum extent permitted by law, Nementum shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Your use of the Service is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless Nementum from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms. You may stop using the Service at any time.
14. Governing Law
These Terms are governed by the laws of the European Union and, where applicable, the laws of Malta, without regard to conflict of law principles.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
